By this petition, the Petitioner has sought a direction to consider his candidature for admission to Under Graduate Technical Course of B.Pharmacy from Special Backward Class for the year 20202021. 2.

The learned Counsel for the Petitioner informs that the cut off date for filing the Form is today. In view of the fact that the cut off date is today and the direction is sought for provisional admission, we have to consider all the facts and circumstances of the case. Choulwar

The Petitioner had earlier sought admission on the basis of Caste Certificate as belonging to Scheduled Tribe "Gond Gowari". The Scrutiny Committee has invalidated the Caste Certificate as belonging to "Gond Gowari". The Petitioner has not challenged this order but now, wants to apply in Special Backward Class Category. The argument of the Petitioner that there was a change in law, cannot be accepted, as Presidential Order continued to include the Caste "Gond Gowari" only. In these circumstances, at such a short notice, a direction cannot be given to the Respondent to accept the Form of the Petitioner as a Member of Special Backward Class as it will affect those candidates who otherwise have all the requisite documents with them.
