The appellant has filed appeal challenging the judgment convicting him for the offence under Section 13(1) (d) punishable under Section 13(2) of the Prevention of Corruption Act, 1988. The sentence was suspended till 1st April, 2016 by the Special Court. The appeal is admitted. I was prima-facie not convinced that the sentence is required to be suspended and therefore, it was proposed that the appeal would be taken up for final hearing. The learned advocate for the appellant informs that the appellant has not surrendered though the sentence was suspended till 1st April, 2016 only. On instructions, the learned advocate for the appellant has submitted that the application praying for suspension of sentence is not pressed at this stage, as it is proposed that the appeal would be taken up for hearing. The application is disposed of as not pressed.
