DATE : APRIL 29, 2015 Prayer is to permit the applicants to withdraw the amount of compensation deposited by the appellant. It is stated that the claimants are the parents of the deceased and are in need of financial aid.

The application is opposed by counsel for the appellant on the ground that the claim as filed itself was not tenable.

Considering the facts of the case, the claimants are permitted to withdraw 50% of the amount of compensation granted subject to furnishing undertaking in this Court that in case the appeal is allowed, aforesaid amount shall be repaid with interest at such rate the Court may direct.

Civil Application is disposed of.
