By the present application, the appellant is seeking injunction against the respondent restraining him from creating any third party interest in the suit property.

It is a matter of record that the suit for specific performance of contract filed by the appellant came to be decreed and the appeal filed by the respondent against the order of decree came to be allowed by the first appellate Court reversing the decree, against which the present second appeal came to filed. By order dated 18/06/2019, the respondent was already directed in the meanwhile not to create third party interest in the suit property.

In view of the above, the application can be disposed of by directing the respondent not to create third party interest in the suit property till disposal of the appeal.

The application is allowed and disposed of accordingly. List the matter after two weeks.
