Heard learned Counsel for the Applicant. Perused the First Information Report.

Counsel for the Applicant submits that the Applicant is a Govt. Servant working in Irrigation Department as a Tracer. From perusal of the FIR, we find that the present Application for quashing of FIR is premature. He submits that the name of the Applicant is not to be found in the Memorandum of Association of the Company in respect of which the grievance is made by the depositors. Even if that is so, we find that it is a matter of investigation as to how the Applicant is concerned, since FIR specifically names him as a person who promised sky and gave nothing. But then that is a matter of investigation and it would be difficult for us to interfere at this stage.

In view of the above, Criminal Application [APL] No. 68 of 2015 is disposed of with liberty to file proceedings at appropriate stage.
