According to the affidavit-in-reply filed by respondent No. 1 - State, Charge sheet No. 98 of 2017 dated 06.12.2017 in the crime is already filed before the Competent court.

Having considering the mixed questions of law and fact, as are involved in the present crime and various statements filed with the charge sheet, we find it appropriate for the petitioners to file discharge application before the Competent Court which can look into all the documents and consider the said application.

With these observations, we grant leave in favour of the petitioners to file application seeking

1707cwp90.18 discharge from Criminal Case No. 451 of 2017, registered on the basis of said crime. Criminal Writ Petition is disposed of in above terms.
