Heard the learned Counsel for the rival parties.
The name of the applicant is not to be found in the FIR. The applicant is in jail since 22-10-2012 and the other accused in the case have been released by this Court and the Supreme Court. The Supreme Court order shows that the test of parity was applied. As to the case of this applicant is concerned he said to have been identified for the first time in the parade. The learned APP state that the discovery of sword has also been made. The record shows that similar are the facts in relation to other accused who have been granted bail. Hence, I am inclined to grant the application by applying the doctrine of parity. I make the following order :- Order A] Criminal Application (BA) No.80 of 2015 is allowed.
B] The applicant shall be released on bail on furnishing a PR bond in the sum of Rs. 10,000/- with one surety in the like amount.
C] The applicant shall not enter the boundary of Yavatmal till the trial is over.
D] The applicant shall attend the Police Station Ambazari, Nagpur on last Sunday of every month till filing of chargesheet between 11.00 am to 04.00 pm.
