09th February, 2018 By this application, the applicant prays that the non-applicant no.5 be restrained from creating any thirdparty rights in the suit property during pendency of the appeal.

In the reply filed on behalf of non-applicant nos. 2,4 and 5, it has been stated that for the present the non-applicant no.5 has no intention of selling the suit property.

Accepting that statement, the application is disposed of. In the event, the non-applicant no.5 intends to dispose of the suit property, he shall give notice to the applicant in advance.
