DATED : 04/02/2019 The original plaintiff has challenged the order passed by the trial Court by which the application filed by him praying that the defendant be directed to maintain status-quo in respect of the service conditions is dismissed. Though the application filed by the plaintiff does not refer to any provisions, necessarily it has to be under Order 39 of the Code of Civil Procedure and it being so, the impugned order is appealable under Order 43 Rule 1 (r) of the Code of Civil Procedure.

In view of the alternate remedy, the writ petition is dismissed. No costs.
