Vide order dated 9/6/2022, this Court has condoned delay in filing application for setting aside order dated 24/2/2022 passed by the Registrar (Judicial) and for restoration of Second Appeal subject to the applicant depositing costs of Rs.3,000/- within two weeks. The applicant was further directed to remove office objections within one week. The applicant has not paid costs within two weeks and further has not removed office objections within one week.
2] The applicants are now seeking to comply order dated 9/6/2022 on the ground that subsequent to demise of the appellant, his wife fell seriously ill and was facing several mental issues and as a result, she was neither in a position to travel nor was in a position to contact her Counsel. Copy of medical prescription is
12-CAO-207-2024 annexed with the application. Accordingly, the applicants are seeking permission to comply order and to bring on record the names of legal representatives of the appellant. 3] In view of above and for the reasons set out in the applications, the same are allowed. The legal representatives of the appellant shall carry out necessary amendment in the cause title of appeal and shall comply order dated 9/6/2022 within ten working days from today.
4] Both the applications are disposed of in above terms.
