Shri Phadnis, learned Counsel for the petitioner invites attention to an affidavit filed vide stamp No. 5126/2016, to urge that in view of the approval given to the petitioner on 18.04.2015 by respondent no.3, the grievance in the matter is redressed. He therefore, seeks leave to withdraw the petitioner with liberty to approach again, if any cause of action arise.

Ms. Rane, learned A.G.P. informs that she

Order 2004wp1127.15 has no instructions either about the communication or the approval dated 18.04.2015. She also submits that reply placed on record has been sworn on 12.08.2015 by the Education Officer and in it this development has not been pointed out.

However, in view of the express affidavit and statement made by Shri Phadnis, learned Counsel for petitioner, we dispose of the Writ Petition as infructuous, with liberty as sought for. No costs. JUDGE JUDGE Rgd.
