Heard Shri Ram Khobragade, learned counsel for the petitioner and Shri A.S. Fulzele, learned APP for respondent Nos. 1 to 4.

We find substance in the preliminary objection raised by the learned APP. The remedy under Section 156(3) of the Criminal Procedure Code appears to be more appropriate.

Hence, keeping all rival contentions open and with liberty to the petitioner to take recourse to that remedy, we dispose of the present proceedings. No costs. JUDGE JUDGE *GS.
