Heard Shri R.R.Vyas, advocate for the applicant and Shri A.K. Bangadkar, A.P.P for the non-applicant. The applicant is arrested in connection with the crime registered by the non-applicant for the offences punishable under Sections 306, 304-B, 498 r/w. 34 of the Indian Penal Code.

The crime is registered on the complaint filed by Shri Arun Thawari (father of deceased Priya), alleging that deceased Priya has consumed poison because of ill-treatment meted out to her by Satish (husband of Priya), Smt. Shobha (mother of Satish) and the present applicant Sandeep (elder brother of Satish). This Court has ordered release of Shobha on bail by order passed on Criminal Application No. 11 of 2016 on 18th January, 2016. The applicant is in custody since 10th December, 2015.

The case of the applicant is that he is residing separately with his wife and is running an auto-rickshaw for his livelihood. It is undisputed that the applicant has not been involved in any crime earlier.

2 ba69.16 The allegations against the applicant are that at the time of marriage he had taken dowry of Rs.2,50,000/- from the father of deceased Priya.

Considering the facts on record, I am inclined to grant prayer of the applicant. Hence, the following order : The applicant having been arrested in connection with Crime/FIR No. 237 of 2015 registered by the nonapplicant for the offence punishable under Section 306, 304-B, 498-A r/w 34 of the Indian Penal Code, he be released on bail on furnishing P.R. Bond of Rs.Ten Thousand and two solvent sureties in the like amount.

The application is allowed in the above terms. CRI.APPLN. (APPP) NO. 127/2016.

In view of disposal of the main application, the application for dispensing with certified copy of the order does not survive, hence, it is disposed of.
