Heard Shri V.N. Morande, advocate for the applicant and Shri N.B.Jawade, APP for the non-applicant. The applicant is seeking pre-arrest bail apprehending arrest in the crime registered against him for the offence punishable under Section 498-A of the Indian Penal Code.

The complainant (wife of the applicant) has lodged report with the police alleging that the applicant is physically and mentally harassing her and demanding money. The applicant as well as complainant (wife) are working as Constables in Police Department.

Considering the facts on record, that the applicant is in service with Police Department and as the non-applicant has not been able to show that the custody of the applicant is required for further investigation, in my view, the interim order granted on 2nd February, 2016 is required to be confirmed.

Hence, the following order :

2 aba62.16 In the event of arrest in Crime No. 664 of 2015 registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond for Rs.Ten Thousand with one solvent surety in the like amount.

The application is allowed accordingly.
