By this petition, the petitioner seeks a direction to the respondents to take a decision on the representation for regularization of the period of absence from duty. The petitioner has further sought a direction to the respondents to grant pensionary benefits to the petitioner on the basis of the order of regularization of the period of absence.
It is stated on behalf of the petitioner that during the pendency of the writ petition, the respondents have regularized the absence of the petitioner from duty and only a direction is required to be issued to the respondents to pay the pensionary benefits resulting from the order of regularization of the services to the petitioner, at the earliest.
Ms Munshi, the learned counsel for the respondent no.3-Zilla Parishad, states that at least a period of three months would be required to pay the dues to the petitioner as certain formalities are required to be completed.
In view of the statement made on behalf of the respondent no.3-Zilla Parishad, we dispose of the writ petition with a direction to the respondents to pay the pensionary benefits to the petitioner as early as possible and positively within a period of four months.
WP723-15 Order accordingly. No costs.
