The applicant is charge-sheeted for offence punishable under Sections 302, 324, 504, 506 and 34 of the Indian Penal Code registered with Police Station Sakharkheda, Buldhana vide Crime 81/2017.
2] The co-accused, who are the father and brother of the applicant are released on bail. The applicant is in custody since 01.05.2017.
3] I have scrutinized the record and the submission of the learned counsel that there appears to be a single stab injury which has caused death appears to be well founded. The postmortem report refers to only one serious injury. 4] The applicant has no criminal antecedents and the possibility that he shall be flee from the course of justice
ba100.20.O.odt is remote. Considering the nature of accusations and the material on record and the fact that the applicant has already suffered incarceration for two years and ten months, this application is allowed.
5] The applicant shall be released on bail subject to the following conditions:
[i] The applicant be released on bail on furnishing P.R. bond of Rs.20,000/- with a surety of like amount.
[ii] The applicant shall not enter the territorial limits of village Gajarkhed till the conclusion of the trial, unless specifically permitted by the trial court to do so.
[iii] The applicant shall not, directly or indirectly make any attempt to influence the witnesses.
