The applicant seeks pre-arrest bail apprehending arrest in connection with crime registered for the offence punishable under Sections 354D, 452, 341, 323, 504 and 506 of the Indian Penal Code and Sections 11(iv) and 12 of the Protection of Children from Sexual Offences Act on the complaint lodged by father of victim, aged about 16 years and 10 months. By order passed on 2nd February, 2017 this Court granted interim protection to the applicant.

It was argued on behalf of the investigating agency that the applicant resides in the locality where the victim is also residing and, therefore, it transpired that if the interim protection is to be continued the applicant should stay out of the village till the charge-

2 aba64.17 sheet is filed. However, except for a vague statement that the applicant will reside at some other place, the details of address where the applicant would be residing were not provided. The hearing of application was adjourned. Today, on instructions, the learned Advocate for the applicant seeks permission to withdraw the application. The application is dismissed as withdrawn. As the applicant has enjoyed interim protection granted by this Court by the order passed on 2nd February, 2017 the applicant is directed to surrender within 3 days, failing which note of the conduct of the applicant be taken at all stages of the proceedings.
