Heard Shri D.P. Shouche, learned counsel for the applicant - petitioner. Nobody is present for the respondents.

It is obvious that the respondents do not wish to contest this application. Even otherwise, for the reasons stated in the application, the same deserves to be allowed and it is accordingly allowed. The necessary amendment be carried out within two weeks.

As regards prayer for grant of interim stay to the recovery is concerned, it cannot be considered at this stage unless the adequate opportunity of hearing is given to the respondents.
