Heard Shri A.N. Ansari, learned Advocate for the petitioner and Ms. T.H. Udeshi, learned Assistant Government Pleader for the respondents.

The learned Assistant Government Pleader states that the impugned order can be challenged under Section 33(4) of the Maharashtra Police Act.

The learned Advocate for the petitioner submits that the appeal under Section 33(4) of the Maharashtra Police Act is not being accepted and considered in view of the Circular issued on 22/12/2015 repealing the rules framed under Section 33 of the Maharashtra Police Act.

Accepting the statement made on behalf of the learned Assistant Government Pleader, the petition is not entertained, as the petitioner has alternate statutory remedy available.

The petition is disposed with liberty to the petitioner to file appeal, if so advised. No costs.
