Shri S.D.Doifode, Addl.G.P. for Respondent No.1. Shri F.T.Mirza, Advocate for Respondent No.2. CORAM : SUNIL B. SHUKRE AND A NIL L. PANSARE, JJ.
DATED : FEBRUARY 11 , 20 .
1.
Hearing was conducted through Video Conferencing and the learned Counsel agreed that the audio and visual quality was proper.
2.
Heard.
3.
By this petition, not one, but two kinds of relaxations are sought. First relaxation is in respect of the age of the petitioner and the second is about extending the last date of submission of the application. Although, no specific prayer has been made as regards the second relaxation.
4.
We would have certainly entertained this petition had the petitioner approached this Court before the last date of submission of the application had expired. One can understand the plight of the
2 wp771-22 candidates who suffered due to non-issuance of the advertisement for filling of the posts of District Judges in the year 2021 and who in the interregnum turned age barred. But, we cannot understand as to why a person desirous of applying for the post of District Judge should sit idle and not do anything till the last date of submission of the application form is over. The relaxation sought in the last date of submission of the application, the last date in the present case is of 27th January 2022, has no connection whatsoever with Covid Pandemic. Therefore, if the petitioner wanted to take recourse to equity jurisdiction of this Court, the petitioner ought to have acted in an equitable manner by filing the petition well in time. The petitioner has not done it. Now, if this petition is to be entertained and allowed, it would also mean that this Court is extending the last date of submission of the application forms and that would open up a whole Pandora's Box. We are, therefore, not inclined to entertain this petition.
5.
The writ petition stands summarily dismissed. No costs.
