AGP for R-1.
CORAM : SMT. VASANTI A. NAIK & V. M. DESHPANDE, JJ.
DATE : MARCH 22, 2016.
By this writ petition, the petitioners challenge the order of the Maharashtra Administrative Tribunal dated 29.10.215 dismissing the contempt petition filed by the petitioners and granting liberty to the petitioners to file a review/fresh application before the Tribunal, as the petitioners may deem fit.
It appears on hearing the learned counsel for the parties and on a perusal of the order on the original application and in the contempt petition that the Tribunal was justified in dismissing the contempt petition filed by the petitioners. The original application filed by the petitioners was disposed of by the order dated 27.4.215 without issuing any direction whatsoever to the respondents. In this background, the Tribunal rightly held that if at all, the petitioners were aggrieved by any subsequent action on the part of the respondents, the petitioners were at liberty to file a review/fresh application before the Tribunal. The Tribunal
wp1374.16 2/2 rightly held that the contempt petition could not have been filed in the absence of any direction to the respondents in the original application.
Since the order of the Tribunal is just and proper, we dismiss the writ petition with no order as to costs. JUDGE JUDGE !! BRW !!
