The accused is convicted for offence punishable under section 363 read with section 34 of the Indian Penal Code.

Criminal Appeal 13 of 2018 which impugned the very same judgment and order by and under which the present applicant is convicted, is fixed for final hearing on 15.2.2018.

In this view of the matter, I am not inclined to suspend the sentence.
