Shri Vishal Anand, learned counsel for the petitioners and Mrs. Joshi, learned AGP for the respondents.
By the present petition, the petitioners who are project affected persons seek directions against the respondents for implementation of Government Resolution dated 18.06.2013. As per aforesaid Government Resolution, a Special Economic Package has been formulated by Respondent No.1 and the modalities thereof have been stated in Government Resolution dated 18.06.2013.
In reply affidavit filed on behalf of Respondent Nos. 2, 4 & 5, in para 3 thereof, it has been stated that the petitioners who are residents of Village - Kosambodi would be entitled for Punarvasan Anudan and compensation in lieu of alternate land as per Government Resolution dated 18.06.2013. Thereafter in
62wp1364.14 para 4, it has been stated that the petitioners would be given benefit of aforesaid Government Resolution in terms of clauses (1) and (2) thereof.
It is to be noted that Annexure C to Government Resolution dated 18.06.2013 contains clauses 1 to 6. As the petitioners have been held entitled to benefit of clause Nos. (1) & (2) thereof, at the third stage, as per Rules in that regard, it is clear that the grievance of the petitioners stands redressed. In view of the aforesaid, by accepting the statements as made in paras 3 & 4 of the additional affidavit dated 23.12.2014, writ petition stands disposed of. No order as to costs.
It is clarified that in case the petitioners experience any difficulty in getting relief in terms of aforesaid clauses (1) & (2) and in case of any fresh cause of action, they are free to approach this Court, if contingencies arise.
