This Petition is filed for a direction to the Respondent No.1State to take a decision on the proposal submitted by the Petitioner for opening a Junior College at Dabha (Jamni), District Bhandara. 2.

Rule was issued in this Petition on 22 November 2010, but no interim relief was granted.

The proposal of the Petitioner was of the year 2008. The said proposal was rejected on 30 September 2008. The perusal of the record shows that the factual position relied upon to justify the need to open a Junior College is of the year 2008, that is 14 years Lanjewar

221-wp-970-2010.odt ago. The rejection is also referable to the situation existing then. Therefore, after 14 years, it cannot be directed that the proposal to start a College to be considered now. If the Petitioner is still desirous of opening a College, it is open to the Petitioner to make a fresh application which will be considered by the Respondents on its own merits.

With these observations, the Writ Petition is disposed of. Rule is discharged. No costs.
