Date : 28 th August, 2017 Shri Sarda, the learned counsel appearing for applicants in Criminal Application No.376 of 2014, seeks permission to withdraw this criminal application with liberty file an application for discharge before the Trial Court raising all such grounds of challenges, which are raised in this application. Permission is granted. Criminal Application No.376 of 2014 is dismissed as withdrawn with liberty, as aforesaid.

2808appp146.15.odt In view of above, Criminal Application No.146 of 2015 is allowed. The non-applicant No.1/State of Maharashtra is permitted to file the chargesheet. The applicants are at liberty to file an application for discharge, which shall be decided by the Trial Court within a period of one month from the date of filing of such application. The application be filed within a period of fifteen days from the date of filing of the chargesheet. The chargesheet be filed within a period of one week from today. If the ultimate decision of the Trial Court is to reject the application for discharge, the trial shall be completed within a period of three months thereafter.
