Nobody for petitioner. Learned AGP Shri A.V. Palshikar has pointed out that validity of final notification issued by Commissioner of Police Amravati banning entry of six seater auto rickshaws and black-yellow jeeps (taxis) has been upheld by this court as per its order dated 15.4.2002 in W.P. Nos.1434 and 1491 of 2006. He submits that the impugned notification dated 27.12.2004 or order dated 30.12.2004 grants relaxation for the use thereof. As such, when original notification which imposed complete ban has been upheld, relaxation granting therefrom cannot give rise to a fresh cause of action. Our attention is invited to reply dated 13.4.2005 filed by respondent no.4 in present matter.

wp832-05 As nobody is appearing for petitioner, we dismiss petition for want of prosecution. Rule discharged. No costs.
