This is an application for condonation of delay in filing the appeal.

The applicant is convicted in Sessions Case No.118 of 2016 by the learned Additional Sessions Judge, Wardha for the offence punishable under Section 302 of the Indian Penal Code.

Heard Ms Sonali Saware, learned counsel for the applicant appointed by the High Legal Services SubCommittee, Nagpur. 4.

Though this application is coming for the first time in our view this application can be allowed since the applicant is in jail. Shri S.M. Ghodeswar, learned Additional Public Prosecutor also fairly submitted that no prejudice will be caused to the prosecution even if the application for condonation of delay is allowed.
