The applicant is arrested in Crime No.156/2015 registered against him for the offences punishable under Sections 342, 363, 395 and 413 read with Section 34 of the Indian Penal Code. The allegations against the applicant is that he has committed theft of Truck alongwith goods. It is alleged that the Truck and goods are seized on the same day on which they were reported to be missing.

Considering the nature of allegations against the applicant, the fact that the applicant has not been involved in any crime earlier and that charge-sheet is filed and the non-applicant has not been able to show that custody of the applicant is required for further investigation, in my view, the applicant is entitled for

Hence, the following order :

i) The applicant having been arrested in Crime No.156/2015 registered by the non-applicant, he be released on bail, on furnishing P.R. Bond of Rs.10,000/- and one solvent surety in the like amount.

ii) The application is allowed accordingly.

Criminal Application (APPP) No.137/2016.

In view of disposal of main application, the application praying for grant of time to file certified copy of say/reply of the A.P.P. has become infructuous. It is disposed accordingly.
