DATE : 4.3.2016 Heard Shri S.H. Sudame, advocate for the applicant and Ms. V.P. Kaliya, A.P.P. for the non-applicant. The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him for the offence punishable under Section 363, 366 read with Section 34 of the Indian Penal Code and Section 9, 10 and 11 of the Prohibition of Child Marriage Act, 2006.
The learned advocate for the applicant has submitted that the accusations made against the applicant do not constitute the offences for which crime is registered against him. It is further submitted that the co-accused are granted bail and, therefore, it cannot be said that the custody of
2 aba66.16 applicant is necessary for further investigation. Considering the nature of allegations and the involvement of applicant in crimes earlier, I am not inclined to consider the prayer of the applicant. The application is rejected.
