DATED : 10th JULY, 2015 The learned counsel for the petitioner seeks leave to withdraw the petition with further liberty to approach the court as and when exigency arises.

The learned counsel for respondent no. 5 vehemently opposes the prayer. The learned counsel submits that on account of pendency of this Public Interest Litigation and on the basis of the averments made in the petition, Chairman of the Nagpur Improvement Trust had passed an order cancelling allotment of grant. He further submits that the same is done without following principles of natural justice. He, therefore, submits that the public interest litigation should not be permitted to be withdrawn.

pil11-14.odt If the petitioner desires to withdraw the present petition, she cannot be compelled to continue with it. The petition is permitted to be withdrawn with liberty as prayed for.

So far as the grievance of respondent no. 5 regarding cancellation of allotment is concerned, the respondent is also at liberty to take such steps as are permitted in accordance with law.
