Shri U. Dastane, learned Counsel for the petitioner, Shri A.S. Fulzele, learned A.P.P. for respondent no.1 and Shri J.B. Kasat, learned Counsel for respondent nos. 2 to 4.

Shri Dastane, learned Counsel points out that on 01.08.2002, the matter has been treated as Civil Writ Petition and is to be heard along with other connected matters. He further states that the issue is answered in favour of petitioner by the Division Bench of this Court on 11.11.2011 in Writ Petition No. 1596/2011.

Shri Fulzele, learned A.P.P. and Shri Kasat, learned Counsel appearing for respective respondents do not dispute this fact. However, they point out that the judgment of this Court in Writ Petition No.1596/2011 is pending in Civil Appeal before the Hon'ble Supreme Court and on 03.12.2012, while granting leave, the judgment has been stayed. That stay continues to operate even today.
