DATE : February 09, 2017 Though the prayer for condoning delay is opposed by the learned counsel for the respondent Nos.1 to 3, considering the reasons mentioned the delay in filing the first appeal stands condoned.

Civil application is allowed and disposed of. F.A.St. No.13405 of 2016 Issue notice for final disposal of the appeal as the learned counsel for the appellant submits that no proper opportunity was granted to the appellant to lead evidence before the Claims Tribunal.

Shri R. Pande, the learned counsel waives notice on behalf of respondent Nos.1 to 3.

C.A.O. No.163/2017 The applicant is permitted to deposit the amount of
