The learned advocate for the applicant, on instructions, states that as the programme of sessions trial is fixed and witness summons are issued, the applicant does not want to prosecute the application at this stage and seeks permission to withdraw the application.

The submissions made by the learned A.P.P. reflect that there is an attempt by the co-accused to protract the trial. If the learned Sessions Judge finds that any accused is attempting to protract the trial she may recommend cancellation of bail granted to such accused. With the above observations, the application is disposed as withdrawn.
