The impugned judgment and decree is dated 23/08/2023. Learned Advocate for the applicant states that application for certified copy was made on 28/08/2023 and certified copy was ready for delivery on 20/09/2023. The date on which judgment is delivered i.e. 23/08/2023 and the period from 28/08/2023 till 20/09/2023 i.e. the date on which application for certified copy was made and the certified copy was ready for delivery should be excluded for the purpose of computation of limitation.

It appears that the appeal is filed on 88th day, which is within prescribed period of 90 days.
