DATE : March 21, 2018 The applicant apprehends his arrest in connection with Crime No.553/2017 registered with Police Station Gittikhadan, Dist. Nagpur for the offence punishable under Sections 406, 420, 465, 467, 468, 471, 120B of the Indian Penal Code. On 22/02/2018 this Court while granting interim protection to the applicant had directed him to cooperate with the investigation and also deposit the sum of Rs.3,50,000/- by 28/02/2018.

The said amount of Rs.3,50,000/- has accordingly been deposited. Thereafter on 08/03/2018 the interim protection was continued as the handwriting sample of the applicant was to be taken. The application was adjourned and kept today. It is informed that the handwriting sample of the applicant has duly taken and the applicant has attended the concerned Police Station as directed. 2/3 Public Prosecutor submits that as of today no crime has been registered against the applicant but investigation in some other matters is in progress. He submits that further amount remained to recover from the applicant is Rs.2,86,259/- and to safeguard the interest of bank further orders need to be passed.

Considering the earlier interim orders and the fact that the applicant has cooperated with the investigation and has deposited the sum of Rs.3,50,000/- and after perusal of the First Investigation Report I am inclined to continue the protection as granted subject to imposing conditions. Accordingly the applicant shall deposit the balance amount of Rs.2,86,259/- with the State Bank of India, Coal Estate, Nagpur within a period of six weeks from today. After such deposit he shall produce receipt of the same with the Investigating Officer.

The applicant shall cooperate with the Investigating Officer and shall attend the concerned police station as and when directed by the Investigating Officer.

If the aforesaid amount is not deposited by the applicant within period of six weeks from today, the order granting protection from arrest to the applicant shall cease to operate without reference to the Court.

3/3 The applicant shall not take any steps to tamper with the prosecution material or influence the prosecution witnesses. The observations made in this order are only for deciding this application which is allowed and disposed of. JUDGE Asmita
