DATE : September 08, 2017 By this application it is prayed that the decree for partition passed by the trial Court be stayed during pendency of the appeal. It is submitted that the appellant along with his family members is residing in the suit property and hence the decree for execution be stayed.

Notice was issued to the respondents on 05/07/2017. The respondents have been duly served. There is no reply filed to the present application. Though the demarcation of shares pursuant to the impugned decree may be carved out, the possession of the appellant shall not be disturbed during pendency of the appeal.
