Heard learned counsel for the parties.

Learned counsel for the respondent Nos. 1 (a) to 1(c) has submitted that the respondent No.3 is wrongly shown in the application and he may be permitted to delete her name.

The appellant has no objection for the same.

Permission is granted to delete the name of Respondent No.3 from the array of the respondents. Necessary amendment be carried out forthwith. It appears the matter is settled in Lok-Adalat and the first appeal is withdrawn by the appellant.

904caf500.19.odt 2 Considering the facts of the case, the legal heirs of the respondent No.1 i.e. respondent Nos. 1(a) to 1(c) are permitted to withdraw the amount deposited by the appellant in this Court.

Civil application is allowed accordingly.
