Heard Shri A.J. Salway, learned Counsel for the petitioner, learned A.G.P. for respondent nos. 1 and 2 and Shri P.D. Meghe, learned Counsel for respondent nos. 3 and 4.

A hostel run at Kharangana, Taluq Arvi, District Wardha by a society Shri Guru Sangameshwar Samaj Sudhar Sanstha, in the name of - Shri Guru Sangameshwar Boys Hostel, has been closed down in

the year 2014. Petitioner who also runs similar hostel offered to manage that hostel, so as to facilitate the cause of boys staying therein.

Shri Salway, learned Counsel appearing on behalf of the petitioner submits that as per the policy of State Government, when such hotels are closed down, to avoid any inconvenience to staff and students, the other hostel in the vicinity is permitted to look after it. He contends that no decision has been taken on request made by the petitioner. He also fairly points out a communication by which the State Government has stated that for a period of six months, hostels should not be allotted.

Learned A.G.P. appearing for respondent nos. 1 and 2 is opposing the petition.

Learned Counsel appearing on behalf of respondent nos. 3 and 4 points out that reply affidavit has been filed by them before this Court.

We are not inclined to go into the unnecessary details at this stage. Hostel which was closed down was receiving grant-in-aid from the State Government. It is obvious that if government wants to

hand over that hostel, it has to allow all eligible parties to apply for it.

In this situation, if government is inclined to continue that hostel or to reopen that hostel, it shall along with the proposal submitted by the petitioner, also consider the proposal of such other willing institutes who may offer to run it.

With these directions and keeping all contentions of Shri Salway, learned Counsel open, we dispose of the Writ Petition. No costs.
