We find that that the petitioner does not fall in any of the prohibited categories of prisoners mentioned in the Circular dated 25.3.2022, he being a prisoner convicted for an offence punishable under Sections 376-D, 328, 506(II) of the Indian Penal Code and Sections 4, 5 and 6 of the Protection of Children from Sexual Offences Act, 2012. Therefore, there is no reason for the prison authorities to deprive the petitioner of the facility of telephone / coin box. Accordingly, we allow the petition and direct the respondents to provide telephone / coin box facility to the petitioner in terms of Circular dated 12.2.2019 and 25.3.2022 forthwith.
