This is an application for condonation of delay filed by the original claimant, who wishes to file the appeal, challenging the compensation granted in his favour by the Reference Court. The delay is of 1349 days. Notices on this application were issued on 16/11/2021. In pursuance to the notices, Ms. Mayuri Deshmukh, learned Additional Government Pleader is appearing for non-applicant No.1 and Ms. Vaishali Khadekar, learned counsel is appearing for nonapplicant No.2 and she has strongly opposed the application.

After having gone through the contents of the application and after hearing the learned counsel for the applicant and non-applicants, I am of the view that the applicant has made out a case for condonation of delay. Hence, I pass the following order.

ORDER

i.

The application is allowed.

ii. Delay stands condoned.

iii. Office is directed to register the appeal. 3.

However, it is made clear that the applicant will not be entitled to claim interest for the delayed period.
