This matter is pending since 2018. In the present matter, the prayer is for quashment of First Information Report No.237/2017 dated 27.05.2017 with Police Station Khadan, District Akola, for the offences punishable under Sections 376, 377, 354-A, 427, 420, 294, 504, 506 and 34 of the Indian Penal Code.

In the meantime, the investigation is over and charge-sheet is ready for filing. Today, learned APP seeks permission to file charge-sheet. Considering the nature of allegations and the offences, we are of the opinion that such permission needs to be granted. Accordingly, permission is granted to file charge-sheet.

In view of the above referred order, the learned Counsel for applicant submits that he wants to raise

911 apl 89-2018.odt challenge to the charge-sheet. He accordingly placed for permission to amend the application.

We are of the opinion that since the charge-sheet is bulky and applicant will have also to add paragraphs to the application raising the grounds for challenge to the chargesheet, the applicant is permitted to file a fresh application. Accordingly, the present application is disposed of with liberty to the applicant to file afresh raising a challenge to file charge-sheet or file any other appropriate proceeding as permissible under the law.
