Heard Ms. Kukday, Advocate holding for Shri V.S. Kukday for the appellant and Shri Nikhil B. Kirtane, Advocate holding for Shri D.V. Chavan for the respondents 2 to 5.

Shri Kirtane states that a cheque/DD/pay order for Rs.50,000/- shall be handed over to the appellant within a week. Ms. Kukday, the learned counsel for the appellant has no objection and is agreeable to withdraw the appeal. It is made clear that the payment of Rs.50,000/- is against the disputed cheque and shall be without prejudice to the respective contentions of the parties in any Civil Suit or other proceedings which may be pending. The statement that Rs.50,000/- shall be paid within a week is accepted as an undertaking to the Court. The oral request to withdraw the appeal in view of the undertaking given by the respondent, is granted.
