JAIN, JJ DATE : 10.8.2015 In response to the notice issued by this court dated 29 th June, 2015 Mr. G.N.Wahurwagh, who is holding the charge of the Chief Officer, Municipal Council, Gondia, is personally present in the court. Affidavit is also filed by Mr. P.L.Urkude, who was at the relevant time holding the charge of the Chief Officer. Apology is tendered in the affidavit. Hence, we discharge the notice issued on 29 th June, 2015.

Insofar as the merits of the matter is concerned, Mr. Parihar, the learned counsel appearing on behalf of the Municipal Council, Gondia makes a statement that the objection of the petitioner would be reconsidered on its merits after giving an opportunity of hearing to the petitioner.
