The learned counsel for the appellant Shri P.A. Abhyankar states, on instructions, that the appellant shall withdraw the appeal and make a representation to Nagpur Improvement Trust (NIT) which may be considered in a time bound manner. Shri P.A. Abhyankar, the learned counsel further states that till the representation is considered, the status-quo may be continued. Shri R.O. Chhabra, the learned counsel for NIT states that if such representation is made within a week, the same shall be decided either way within six weeks and till the representation is decided either way, the appellant shall not be evicted from the suit plot.

In this view of the matter, the appeal is disposed of as withdrawn in the aforestated terms.
