Shri Dharmadhikari, the learned counsel for the petitioner, states that since it is the stand of the Government that the petitioner ought to have made an application for removal of the encroachment by the concerned respondents on the land vesting in the Government under Section 50 of the Maharashtra Land Revenue Code, 1966, the petitioner would avail the other remedy and approach the Collector, in that regard. It is stated that the petitioner is desirous of withdrawing the writ petition, in this background. Permission to withdraw the writ petition is granted.

The writ petition is disposed of as withdrawn. The points raised in the petition are kept open. JUDGE JUDGE APTE
