Shri Mir Nagman Ali, learned counsel for the applicant fairly states that after liberty was granted by this Court to file a fresh application, if the trial is not concluded within a period of three months from the date of the order i.e. 18.06.2021, he has not filed application before the trial Court but directly approached to this Court.

He further points out that after the order dated 18.06.2021, the trial Court has granted bail to one of the coaccused on 25.02.2022. In the said backdrop, he prays for withdrawal of the present application with liberty to move a fresh application before the trial Court.

Accordingly, permission to withdraw the application is granted with liberty as sought for. C.L.Dhakate
