The applicant has sought pre-arrest bail apprehending arrest in crime registered against him and three others for the offence punishable under Sections 420, 468, 471 read with Section 34 of the Indian Penal Code. The accusations against the applicant are that the applicant who was working as Naib-Tahsildar has colluded with the co-accused Satish and and his wife in preparing an order showing conversion of agricultural land into non-agricultural land.

The facts on record show that the sale deed of the agricultural land in question was executed in favour of Satish and his wife on 8th October, 2012. Undisputedly, the applicant, who was working as Naib-Tahsildar, has retired on attaining the age of superannuation on 31st July, 2011. The name of the

2 aba71.17 applicant did not appear in the F.I.R. The applicant is granted interim protection by this Court by order passed on 7th February, 2017. The investigating agency has not complained that the applicant has misused the interim protection granted by this Court.

Considering the facts of the case, in my view, the interim protection granted by this Court by the order passed on 7th February, 2017 is required to be confirmed. The order is confirmed and the application is allowed accordingly.
