The learned counsel for the respondents raises a preliminary objection to the tenability of the writ petition on the ground that the petitioner has an alternate remedy of filing an appeal against the impugned order.

The learned counsel for the petitioner states that the petitioner would withdraw the writ petition and avail the alternate remedy. It is stated that since the petitioner was bona fide prosecuting the matter before this Court, liberty may be granted to the petitioner to avail the alternate remedy. Permission and liberty, as prayed for, are granted. The writ petition is disposed of as withdrawn. The points raised in the petition are kept open. JUDGE JUDGE APTE
