The applicant had filed a complaint case against the non-applicants praying that they be punished for the offence punishable under Sections 494 and 109 of the Indian Penal Code. By judgment dated 19th July, 2012 the learned Magistrate convicted the accused. This judgment was challenged by the accused before the Sessions Court in appeal which is allowed and the accused are acquitted. The applicant / complainant seeks leave to challenge the judgment passed by the Sessions Court.

Considering the facts of the case, I am satisfied that the applicant has made out case for grant of leave to file and prosecute the appeal. Leave is granted. Criminal application is allowed accordingly.
