Heard Shri K.G.Mendhe, advocate for the applicant and Ms N.P. Mehta, A.P.P. for the non-applicant. The applicant is arrested in the crime registered against him for the offence punishable under Section 377 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act, 2012.

It is on record that the victim is a boy aged about 12 years. The non-applicant has stated in the reply that the medical examination reports of the applicant/ accused and the victim show the commission of offence. Hence, considering the nature of the offence and the facts on record, I am not inclined to show indulgence.

The application is dismissed.
